КАК НАМ УДАЛОСЬ УБЕДИТЬ КАНЦЕЛЯРИЮ ПРИНЯТЬ РАПОРТ, КОГДА БОЕЦ БЫЛ В СЕРОЙ ЗОНЕ СВЯЗИ.
Мы в Профсоюзе военных юристов регулярно берём в работу дела военнослужащих, находящихся непосредственно в зоне СВО. Существенная проблема там - это связь. Подать рапорт - целое серьёзное дело.
Наш недавний доверитель в блиндаже, под прилётами пытался передать документ через командование. «Сейчас некому принимать», «Потом занесёшь, когда будет затишье», «Я твою бумажку в карман положу» — увы, это классика. В итоге рапорт растворялся в воздухе. Через неделю на вопрос об ответе командир разводил руками: «Какой рапорт? Ты мне ничего не давал».
Задача: 1. Подать рапорт так, чтобы у него появился «документальный или цифровой след», который нельзя игнорировать или «потерять в кармане». 2. Сделать это дистанционно, не нарушая режим секретности и не подставляя подразделение. 3. Создать доказательную базу для военной прокуратуры на случай, если командование продолжит играть в молчанку.
План, который сработал: Военные юристы Профсоюза знают, в зоне СВО не работает канцелярия, работает только государственная логистика. Мы перевели подачу рапорта из плоскости «человек-человек» в плоскость «гражданин-государство». 1. Юридическая упаковка. Мы составили текст рапорта. Жёсткое правило: ни слова о позициях, маршрутах, секретных задачах. Только суть проблемы (выплаты, статус, документы). 2. Бумажный след. Мы отправили рапорт регистрируемым почтовым отправлением на официальный почтовый адрес воинской части. Не просто письмом, а с описью вложения и трек-номером. Чек и трек-номер боец сохранил. 3. Цифровой двойник. Параллельно через сервис «Электронные заказные письма» Почты России мы загрузили скан этого же рапорта. Важный нюанс, который спасает: если у части отключён электронный приём, Почта России сама распечатывает письмо и доставляет его в конверте. Но в вашем личном кабинете навсегда остаётся квитанция об отправке с датой и временем. Это тоже доказательство.
Результат Игнорировать юридически грамотно оформленный документ и государственную службу доставки невозможно — это уже не «потерянная бумажка», это уклонение от регистрации входящей корреспонденции. Сейчас рапорт официально зарегистрирован. Если бы командование продолжило молчать, можно было бы смело писать жалобу в военную прокуратуру.

5 НАИБОЛЕЕ ЧАСТЫХ СХЕМ И ЧТО С ЭТИМ ДЕЛАТЬ. ИЗ ПРАКТИКИ ВОЕННОГО ЮРИСТА.
Схема 1. Контракт подписан ДО медосмотра Как это выглядит: Вам дают ручку и бумаги в штабе. Вы ставите подпись. И только потом вас отправляют к врачам «для галочки». В чем подвох: По закону (ст. 33 ФЗ № 53) контракт заключается только ПОСЛЕ признания вас годным. Если вы подписали его заранее, вы уже в ловушке — юридически вы согласились служить, еще не зная своего состояния здоровья. Что делать: Такой контракт можно и нужно отменять через суд (ст. 218 КАС РФ). Главное доказательство — хронология: дата подписи договора раньше даты заключения ВВК.
Схема 2. «Годен» на бумаге — в штурм на практике Как это выглядит: У вас есть проблемы со здоровьем, но медицинскую карту либо «потеряли», либо просто не смотрят. Вас отправляют в зону боевых действий, игнорируя противопоказания. В чем подвох: Доступ к своим же документам в части часто намеренно затруднен. Без выписки доказать, что вас не имели права отправлять, почти невозможно. Что делать: Фиксировать каждый запрос на получение медкарты письменно. Если карту не выдают — это уже повод для жалобы в прокуратуру. Любой шаг в зону СЧ без учета противопоказаний при наличии диагноза — основание для иска.
Схема 3. Ранение есть, а категории «Д» или «В» нет Как это выглядит: После госпиталя есть заключение хирурга, есть снимки, есть боли. Но ВВК тянет резину месяцами, оставляя вас в подвешенном статусе. В чем подвох: Затягивание — это форма психологического давления. Система надеется, что вы махнете рукой и вернетесь в строй. Что делать: Как только объективные данные (КТ, МРТ, заключение врача) на руках, а ВВК молчит — это классическое «бездействие должностных лиц». Срок исковой давности по таким делам — всего 3 месяца. Не ждите — подавайте в суд и дублируйте жалобу в военную прокуратуру.
Схема 4. Смерть или болезнь близких? Отказ в отпуске Как это выглядит: Случилась беда дома. Вы пишете рапорт на отпуск по личным обстоятельствам (до 10 суток по ст. 11 п. 10 ФЗ № 76). Командир его «не видит», «забывает» или просто отказывает. В чем подвох: Командование часто подменяет понятия, выдавая 10 суток обязательного отпуска за поощрительное «на усмотрение командира». Это незаконно. Что делать: Рапорт должен быть в двух экземплярах с отметкой о вручении. Игнорирование — это снова бездействие. Тот же алгоритм: военная прокуратура и иск в суд.
Схема 5. Ваши жалобы уходят в пустоту Как это выглядит: Вы пишете в часть, в округ, в инстанции. В ответ — тишина месяцами. В чем подвох: Нет бумаги — нет проблемы. Устные обращения в армии не существуют. Что делать: Работает только параллельный трек. Пишете жалобу в прокуратуру и фиксируете сроки: «С момента подачи рапорта прошло 30 дней, ответа нет». Это готовая база для иска по КАС РФ.
3 правила, которые работают: 1. Только бумага. Любой рапорт, заявление, жалоба — только письменно. С отметкой о вручении на вашей копии или заказным письмом с описью. Устные обещания офицеров в суде — это просто слова. 2. Медицина — ваш щит. Собирайте все выписки, заключения профильных врачей, результаты КТ и МРТ СРАЗУ. Делайте копии, заверяйте их. Как только документы попадают в канцелярию части, они имеют свойство исчезать. 3. Таймер на 3 месяца. Срок обжалования действий и бездействия по КАС РФ — всего 3 месяца с момента, когда вы узнали о нарушении. Пропустить легко, восстановить — сложно.
Почему в этих схемах почти невозможно победить в одиночку? Система работает на износ. Вам будут отказывать в выдаче справок, терять ваши рапорты, тянуть время до истечения сроков давности. Задача военного юриста — лишить систему этого преимущества. Я перевожу ваши проблемы на язык обязательных для исполнения адвокатских запросов, фиксирую каждое бездействие и бью по срокам, пока командование ищет способы вам отказать.
