📢 Верховный суд РФ: как легализовать машину из недружественной страны, если она в розыске?
Громкая история из Петербурга, которая меняет правила игры на вторичном рынке авто. Верховный суд России встал на сторону автовладельца и фактически обязал МВД регистрировать машины, которые числятся в международном розыске по линии Интерпола, если запрос на розыск пришел из недружественного государства.
**Суть дела:** Житель Санкт-Петербурга Данила Косачев купил автомобиль в Канаде. При попытке поставить его на учет в ГИБДД выяснилось, что машина находится в международном розыске. МВД отказало в регистрации, сославшись на прямой запрет закона. В итоге дорогая покупка с уплаченными пошлинами и утильсбором превратилась в недвижимость.
**Позиция Верховного суда:** Суды трех инстанций уже признавали отказ полиции необоснованным, так как данные от Канады носили «предположительный характер». Однако финальную точку поставил Верховный суд. Коллегия по гражданским делам указала, что российские власти не обязаны исполнять запросы на розыск в ущерб собственным гражданам.
**Главное из решения:** ▶️ **Приоритет интересов граждан:** Суды должны защищать законные интересы россиян, владеющих транспортом, который объявлен в розыск недружественными государствами. ▶️ **Презумпция недостоверности:** Сведения о хищении, поступающие от недружественных стран, для России носят предположительный характер, пока не доказано обратное. ▶️ **Новое основание для легализации:** Теперь исключить машину из базы розыска можно не только по заявлению инициатора (который просто не отвечает на запросы) или по истечении срока давности, но и на основании решения российского суда в интересах гражданина.
МВД пыталось доказать, что снять машину с учета Интерпола может только сама Канада или время. ВС РФ добавил третий вариант — решение российского суда.
⁉️Что это значит для водителей? Если вы купили машину с японского аукциона или напрямую в Европе/Северной Америке, и внезапно всплыл «красный угол» от недружественной страны, теперь есть четкий алгоритм действий. Главное — зафиксировать факт отсутствия ответа от иностранного бюро Интерпола на запрос наших правоохранителей.
‼️Важно: это решение касается именно тех случаев, когда иностранная сторона игнорирует запросы российской полиции о подтверждении розыска и не проявляет интереса к возврату имущества.

📢«Честный знак» для запчастей: защита потребителя или негласный налог на автобизнес?
‼️С 1 марта 2027 года маркировка «Честный знак» станет обязательной для рынка автокомпонентов. Сторонники нововведения говорят о наклейке за 60 копеек и защите от контрафакта. Участники рынка же считают иначе: с учётом оборудования, ПО, персонала и логистики реальная стоимость маркировки вырастает до 40 рублей за единицу — почти в 70 раз. Представитель Amtel Алексей Сыров привёл пример: маркировка склада на 1,4 млн единиц товара обходится минимум в 4 млн рублей!
Руководитель сети СТО «Реактор» Илья Николин и вовсе говорит о том, что для реализации маркировки компаниям придется создать целый отдел. В его номенклатуре — 16 600 карточек товара. Одному человеку при восьмичасовом дне только на их создание уйдёт год. А ещё нужно распечатать и наклеить маркировки, принимать поставки, сверять документы и разбираться с ошибками, из-за которых склад простаивает неделями. Для дорогих деталей прибавка в 40 рублей незаметна, но для запчастей за 100–150 рублей это 25–50% к цене.
⚡️Силы ПВО и мобильные огневые группы сегодня сбили над Пермским краем 11 БПЛА, сообщил губернатор Дмитрий Махонин. Пострадало пять человек. Во время атаки промышленный объект на севере края получил незначительные повреждения, он продолжает работать в штатном режиме.
«По предварительной информации, пострадали пять человек — работников предприятия. Из них трое направлены на осмотр в приемное отделение больницы, один — на амбулаторное лечение, еще один отказался от осмотра. Состояние всех пострадавших оценивается как удовлетворительное, им оказывается необходимая медицинская помощь», — написал губернатор.
Правительство внесло в Госдуму законопроект, который увеличивает штраф за управление автомобилем без водительского удостоверения с 15 тыс. до 30 тыс. рублей.

За повторное нарушение предлагается взыскивать от 30 тыс. до 50 тыс. рублей. Рассмотрение таких дел передадут органам внутренних дел и военной автомобильной инспекции. Кроме того, по этим статьям исключат возможность оплатить штраф со скидкой 25% в первые 30 дней.
В пояснительной записке отмечается, что в КоАП сейчас нет специальной нормы для более строгого наказания злостных нарушителей. Это позволяет многократно садиться за руль без прав, пренебрегая безопасностью граждан.
Глава комитета Госдумы по транспорту Евгений Москвичев поддержал инициативу. «Эту меру поддерживаем, она давно назрела», - сказал он Интерфаксу.
